Terms and Conditions

Welcome to Nutix. These Terms and Conditions ("Terms") govern your use of the Nutix mobile application ("App") and related services ("Service"). By downloading, installing, or using Nutix, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Definitions

  • "App" refers to the Nutix mobile application
  • "Service" refers to all features and functionality provided by Nutix
  • "User," "You," and "Your" refer to individuals who access or use the App
  • "We," "Us," and "Our" refer to Nutix and its operator, Hakim Mohamed
  • "Content" refers to any text, images, photos, data, or other materials uploaded, submitted, or stored through the App

Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet these age requirements. If you are under the age of majority in your jurisdiction, you must have your parent or guardian's consent to use the App.

Account Registration

To use certain features of the App, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may sign in using your Apple ID or Google account. By doing so, you authorize us to access certain account information as described in our Privacy Policy.

Use of the Service

Nutix provides an AI-powered calorie tracking service that allows you to:

  • Log and track meals and nutritional intake
  • Take photos of food for AI-powered nutritional analysis
  • Monitor weight and health metrics
  • Track intermittent fasting periods
  • Sync data with Apple HealthKit
  • View nutrition trends and analytics
  • Receive reminders and notifications

Fair Usage Policy

To ensure a quality experience for all users and maintain the sustainability of our AI-powered features, Nutix implements fair usage limits on certain features.

AI Nutritional Analysis Limits:

  • Free Plan: 1 AI food photo analysis per day
  • Premium Plan: 100 AI food photo analyses per day

Meal Logging Limits:

  • Free Plan: 3 meals per day
  • Premium Plan: 10 meals per day

Custom Food Creation Limits:

  • Free Plan: 1 custom food per day
  • Premium Plan: 50 custom foods per day

How Limits Work:

  • All usage limits reset daily at midnight (UTC)
  • When you reach your daily limit for any feature, that feature will be temporarily unavailable until the next day
  • Unused daily allowances do not roll over to the next day
  • Upgrading to Premium instantly unlocks higher limits for the current day

Prohibited Usage:

  • Using automated tools, bots, or scripts to access AI features
  • Attempting to circumvent or manipulate usage limits
  • Sharing account credentials to multiply usage allowances
  • Using the service in a way that negatively impacts other users or our infrastructure

We reserve the right to suspend or terminate accounts that violate this Fair Usage Policy. We may also modify usage limits at any time with reasonable notice to users.

User Content and License

Your Content: You retain ownership of all Content you submit to the App, including food photos, meal logs, and personal health data.

License Grant: By submitting Content to the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, and store your Content solely for the purpose of providing and improving the Service to you. This license includes the right to:

  • Process your food photos through our AI systems
  • Store your meal logs and nutritional data
  • Display your data back to you within the App
  • Create backups to prevent data loss

Important: We do NOT use your Content to train AI models. Your Content is used solely to provide services to you personally.

Content Responsibility: You are solely responsible for the Content you submit. You agree not to submit Content that is illegal, offensive, or infringes on others' rights.

User Responsibilities

When using the App, you agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to interfere with or disrupt the Service or its servers
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems or software to extract data from the App
  • Impersonate any person or entity
  • Share your account credentials with others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts

Health Disclaimer and AI Accuracy

Important - Please Read Carefully:

Nutix is designed to help you track nutrition and is for informational purposes only. The App is NOT a medical device and is NOT a substitute for professional medical advice, diagnosis, or treatment.

AI Nutritional Analysis:

  • Our AI provides estimates of nutritional content based on food photos and descriptions
  • These estimates may not be 100% accurate and should be used as a general guide only
  • Actual nutritional values may vary based on portion sizes, preparation methods, and specific ingredients
  • Do not rely solely on AI estimates for medical or dietary decisions

Medical Advice:

  • Always consult a qualified healthcare provider before making changes to your diet or exercise routine
  • If you have diabetes, eating disorders, or other medical conditions, consult your doctor before using calorie tracking apps
  • If you have any medical conditions, consult your doctor before using fasting features
  • We are not responsible for any health decisions you make based on information from the App
  • In case of a medical emergency, contact emergency services immediately

Intellectual Property

The App, including its design, code, features, functionality, logos, and branding, is owned by Nutix and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App without our prior written consent.

Subscriptions and Payments

Some features of the App may require a paid subscription. If you purchase a subscription:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
  • You can manage and cancel subscriptions in your device's account settings (App Store or Google Play)
  • No refunds will be provided for any unused portion of a subscription period
  • Refunds are subject to the policies of Apple or Google, as applicable

Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Nutix only, not with Apple Inc. ("Apple")
  • Nutix, not Apple, is solely responsible for the App and its content
  • Apple has no obligation to provide maintenance or support services for the App
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation
  • Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, or claims under consumer protection laws
  • In the event of any third-party claim that the App infringes intellectual property rights, Nutix, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary

Google Play Terms

If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. In the event of any conflict between these Terms and the Google Play Terms of Service, these Terms shall prevail with respect to your use of the App.

Third-Party Services and Links

The App may integrate with or contain links to third-party services, including:

  • Apple HealthKit
  • Sign in with Apple / Sign in with Google
  • Firebase services

These third-party services have their own terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of such services is at your own risk.

Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by deleting your account through the App settings. Upon termination, your right to use the App will immediately cease, and your data will be deleted in accordance with our Privacy Policy.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NUTIX, ITS OPERATOR, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE APP; (E) ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE NUTRITIONAL INFORMATION PROVIDED; OR (F) ANY HEALTH DECISIONS YOU MAKE BASED ON INFORMATION FROM THE APP.

Indemnification

You agree to indemnify, defend, and hold harmless Nutix, its operator Hakim Mohamed, and any affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your Content caused damage to a third party.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution in the courts of Egypt.

Electronic Communications

By using the App and providing your email address, you consent to receive electronic communications from us, including service announcements, administrative messages, and other information related to your account or the App. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements.

Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page, updating the "Last updated" date, and where appropriate, notifying you via the App or email. Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nutix regarding your use of the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Nutix.

Assignment

You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
